Terms of Service

These Terms of Service govern your access to and use of WineApp (wineapp.ge). WineApp is operated by the business identified in the Contact section below ("we", "us"). By creating an account, starting a trial, or purchasing a subscription, you agree to these terms.

1. The Service

WineApp is a web-based software-as-a-service (SaaS) application for wineries. It lets you manage cellar rooms and vessels, wines and bottled wines, laboratory analyses, sales, and bottle collections, and it offers AI-assisted features such as wine label reading and bottle-photo background removal. WineApp is software only: we do not sell, ship, or deliver wine or any other physical goods. WineApp is offered primarily to wineries in Georgia and is available worldwide.

2. Accounts and Eligibility

You must be at least 18 years old and use WineApp for business or professional purposes. You must provide accurate registration information and keep your password confidential. You are responsible for all activity under your account. A winery owner who invites team members is responsible for their access and for their actions within the winery workspace.

3. Free Trial

New accounts receive a 14-day free trial with 15 bonus credits. No payment card is required to start the trial. During the trial you can use up to 3 rooms with 20 vessels each and 3 collections with 20 bottles each. When the trial ends, access is restricted until you subscribe to a paid plan. If you subscribe during the trial, the remaining trial days are added to your first paid period.

4. Plans and Prices

Paid plans are sold for monthly or yearly periods. Prices are in Georgian lari (GEL); the final amount, including any applicable taxes, is shown before you pay.

Pro: 25 GEL per month or 200 GEL per year. Up to 10 rooms with 20 vessels each, 10 collections with 20 bottles each, up to 5 staff members besides the owner, and 300 credits every month (on both monthly and annual billing).

Business: 50 GEL per month or 400 GEL per year. Up to 20 rooms with 20 vessels each, 20 collections with 20 bottles each, up to 10 staff members besides the owner, and 600 credits every month (on both monthly and annual billing).

Credit top-up: a one-time purchase of 100 credits for 5 GEL, available to active subscribers.

5. Payments

WineApp is sold by Individual Entrepreneur Levan Kurdiani (Georgia). Card payments are processed by UniPAY (unipay.com), a payment service provider registered with the National Bank of Georgia, on its secure hosted payment page. You enter your card details only on UniPAY's page; WineApp never receives or stores them. Paid access starts only after UniPAY confirms the payment to our server. You receive an email receipt for every payment. Payments through UniPAY are accepted only for WineApp's own software subscriptions and credits.

6. Delivery of the Service

WineApp is delivered online; nothing is shipped. After the payment provider confirms your payment, the purchased plan or credit top-up is activated in your account automatically, usually within a few minutes, and a receipt is sent to your account email address. The service is then available in your browser at wineapp.ge. The free trial starts as soon as your account is created. If paid access has not been activated within 24 hours of a successful payment, contact us by email or phone (see the Contact section) and we will activate it or refund the payment in full.

7. Renewal and Cancellation

Plans do not renew automatically, and your card is never charged again without your action. We email you a reminder before your paid period ends; you can renew from the Billing page up to 7 days before the end date, and the remaining days are added to the new period. If you do not renew, paid access ends 3 days after the end date and your data is kept. You can stop a paid plan at any time simply by not renewing it. If we change plan prices, the new price applies only to purchases made after the change. If we later offer automatic renewal, it will apply only if you explicitly choose it at checkout.

8. Credits

Credits pay for metered AI features: reading a wine label costs 1 credit and removing a photo background costs 1 credit. Subscription credits are refreshed every month on all paid plans, including annual plans (monthly from your billing date), and unused subscription credits do not carry over to the next month. Trial bonus credits and top-up credits do not expire while your account exists. Credits have no cash value, cannot be transferred, and are not refundable except as described in our Refund Policy. Regular photo uploads do not use credits.

9. Refunds

Refunds are governed by our Refund Policy. In short, you may request a full refund within 14 days of your first subscription payment without giving a reason, and credits used for an AI operation that fails because of a technical error are returned to your balance automatically.

10. Your Data

You own the winery data and images you upload. You grant us a limited license to host, process, and display that data solely to provide and secure the service. You must not upload unlawful content or data you do not have the right to process. How we handle personal data is described in our Privacy Policy.

11. AI-Assisted Features

Label reading, object detection, and background removal are performed by automated third-party AI services. Results may be inaccurate or incomplete; please review extracted data before relying on it.

12. Acceptable Use

You may not reverse engineer the service, attempt unauthorized access, interfere with its operation, abuse credits or API limits, resell access, share accounts to get around plan limits, or use the platform for any illegal activity.

13. Intellectual Property

The WineApp software, design, and brand remain our property. Your subscription gives you a limited, non-exclusive, non-transferable right to use the service for your business during your subscription.

14. Availability and Changes

We aim to keep WineApp available at all times but do not guarantee uninterrupted service; maintenance and outages can happen. We may improve, change, or remove features. We will not materially reduce the core features of a paid plan during a period you have already paid for.

15. Disclaimer and Limitation of Liability

WineApp is a management tool and does not replace professional oenological, legal, tax, or accounting advice. To the maximum extent permitted by law, the service is provided "as is", we are not liable for indirect or consequential losses, and our total liability is limited to the total amount you paid us for WineApp in the 12 months before the event giving rise to the claim. This applies equally to monthly and annual plans; for an annual plan it includes the full annual fee if it was paid in that period. Nothing in these terms limits rights that cannot be limited under applicable consumer law.

16. Termination

You may stop using WineApp at any time and delete your account from your Profile page or by emailing info@wineapp.ge. Deleting the owner account deletes the whole winery, including staff accounts, and cancels your subscription so it does not renew; refunds follow our Refund Policy. You can restore the account from the link we email you for 30 days, after which it is permanently deleted. During those 30 days you can also request an export of your data by email. We may suspend or terminate accounts that violate these terms, fail to pay, or abuse the service.

17. Changes to These Terms

We may update these terms. For material changes we will notify you by email or in the app before they take effect. Continuing to use WineApp after the effective date means you accept the updated terms.

18. Governing Law

These terms are governed by the laws of Georgia. Disputes shall be resolved by the competent courts of Georgia, unless mandatory consumer protection law provides otherwise.
